M&V Digital Solutions is a fictitious business name (DBA) of Fractional Lab LLC, a California limited liability company. References to "M&V," "we," "us," or "our" in this policy refer to Fractional Lab LLC doing business as M&V Digital Solutions.

We operate the Agent Manager Platform accessible at mvdigital.solutions and its subdomains (the "Platform"). This Privacy Policy describes how we collect, use, store, and protect information when you use our Platform.

By accessing or using the Platform, you agree to this Privacy Policy. If you do not agree, please discontinue use of the Platform.

2. Information We Collect

2.1 Account Information

When your brokerage is onboarded to the Platform, we collect:

  • Name and email address of authorized users
  • Brokerage business name
  • Brokerage logo and brand colors (optional)

Account creation is provisioned by M&V — there is no public self-registration.

2.2 Business Information

To enable certain Platform features (such as SMS messaging), we collect business details including:

  • Legal business name
  • Employer Identification Number (EIN)
  • Business address and website URL
  • Authorized representative contact information

2.3 Client and Lead Data

Depending on which features you enable, the Platform may process data about your clients and leads, including:

  • Names, email addresses, phone numbers, and mailing addresses
  • Property addresses and transaction history
  • Birthdays and personal notes you provide
  • Lead inquiries and communication history

You are responsible for ensuring you have the appropriate rights and consents to provide this data to the Platform.

2.4 Usage and Technical Data

We automatically collect:

  • Login timestamps and session activity
  • Feature usage and agent interaction metrics
  • Browser type, IP address, and device information transmitted in standard web requests

2.5 Payment Information

Billing is processed through Stripe. We do not store credit card numbers or full payment details on our servers. We retain only a Stripe customer identifier linked to your account.

3. How We Use Your Information

We use collected information to:

  • Provide, operate, and maintain the Platform and its agents
  • Process and respond to leads on your behalf (e.g., SMS responses, email outreach)
  • Generate marketing content, nurture communications, and follow-up outreach as configured by you
  • Process billing and manage subscriptions
  • Send transactional notifications (e.g., account invitations, password resets, billing alerts, daily approval summaries)
  • Monitor Platform performance, debug issues, and improve our services
  • Comply with legal obligations

We do not sell your information or your clients' information to third parties.

4. AI-Generated Communications

The Platform uses artificial intelligence to generate communications on behalf of your brokerage, including SMS messages, emails, social media posts, and handwritten card content. Key points:

  • Human approval required. All AI-generated outreach requires your review and approval before it is sent, unless you have explicitly enabled auto-send features.
  • No independent AI decisions. The Platform's AI does not autonomously contact your clients or leads without your configured instructions and approval workflows.

5. Data Sharing and Third-Party Services

We share data with third-party service providers only as necessary to operate the Platform.

We may also disclose information if required by law, legal process, or to protect the rights, property, or safety of M&V, our users, or the public.

6. Data Security

We implement the following security measures:

  • Encryption at rest. All personally identifiable information (PII), including client names, emails, phone numbers, addresses, and birthdays, is encrypted using Fernet symmetric encryption.
  • Encryption in transit. All data transmitted between your browser and our servers is protected via TLS/HTTPS.
  • Tenant isolation. Your data is logically isolated from all other brokerages on the Platform through application-level query scoping and database-level row-level security policies.
  • Authentication security. Passwords are hashed using bcrypt. Session tokens are stored in httpOnly, Secure cookies.
  • PII redaction. Internal observability and debugging tools automatically redact PII from logs and traces by default.
  • Access controls. Only authorized M&V personnel can access internal administration tools. Sensitive actions are audit-logged.
  • Third-party token protection. OAuth tokens for connected services (Gmail, Meta, Microsoft) are encrypted at rest and decrypted only at the time of use.

7. Data Retention

  • Active accounts. We retain your data for as long as your account is active and your agents are enabled.
  • Agent data. When an agent is disabled, its historical data remains accessible in read-only mode.
  • Observability data. Internal logs, conversation traces, and debugging data are automatically deleted after 90 days unless flagged for review.
  • Account termination. Upon request, we will delete your account data within 30 days, subject to any legal retention requirements.

8. Your Rights

You have the right to:

  • Access the personal data we hold about you and your clients
  • Export your client data in CSV format
  • Correct inaccurate information in your account or client records
  • Delete your account and associated data by contacting us
  • Opt out of non-essential communications from M&V

9. CAN-SPAM Compliance

Email communications sent through the Platform on your behalf include:

  • A functioning unsubscribe link in every message
  • Accurate sender identification (your name and email)
  • Non-deceptive subject lines
  • Your brokerage's physical business address

Recipients who unsubscribe are immediately suppressed from future email delivery through the Platform.

10. SMS Communications

SMS messages sent through the Platform comply with applicable regulations:

  • All outbound SMS includes opt-out instructions ("Reply STOP to opt out")
  • STOP requests are processed immediately — no further messages are sent
  • Messages are sent only in response to lead inquiries or as configured by you
  • Phone numbers are registered through proper A2P 10DLC channels via Twilio

You are responsible for ensuring your lead intake forms include appropriate SMS consent language.

11. Cookies and Tracking

The Platform uses essential cookies only:

  • Authentication cookies (httpOnly, Secure) to maintain your login session
  • Tenant identification to route you to the correct brokerage dashboard

We do not use third-party advertising cookies.

12. Children's Privacy

The Platform is designed for business use by real estate professionals. We do not knowingly collect information from individuals under the age of 18.

13. Changes to This Policy

We may update this Privacy Policy from time to time. Material changes will be communicated via the Platform dashboard or email notification. Continued use of the Platform after changes constitutes acceptance of the updated policy.
